Article 10 of the LSSI Applies to Every Site, Including Yours
The aviso legal is the single most breached digital rule in Spain among pymes and autónomos, and the reason is that people assume it is for large companies. Article 10 of Ley 34/2002 makes no distinction by size. A sole trader with a one-page presentation site carrying any economic activity is covered in the same terms as a marketplace. What has to be there: the owner’s identity and address, NIF or CIF, registration details where the business is registered, contact route, and for regulated professions the licence number and governing body. An online store adds pricing, applicable taxes and delivery costs. The sanction regime runs in three tiers, from the lightest band up to €600,000 at the most serious end, supervised by the Secretaría de Estado de Telecomunicaciones with the AEPD handling cookies and commercial communications.
Ley 11/2023 Brought the EAA Into Spanish Law
Spain transposed the European Accessibility Act through Ley 11/2023 of 8 May, with the obligations biting from 28 June 2025. The technical reference is UNE-EN 301549:2022, which for web purposes means WCAG 2.1 at Level AA — and extends beyond websites into mobile apps, electronic documents, software and self-service terminals. If your site sells to consumers, takes bookings or runs any transactional path, this is the standard your store or booking flow is measured against.
The Subsidy Consequence Is the One That Bites First
Fines get the headlines. In Spain the more immediate commercial risk for a small business is different: a company sanctioned for accessibility failures can be shut out of public grants and subsidy programmes, Kit Digital among them. For a business that has built part of its digitalisation plan around that funding, losing eligibility costs more and faster than any realistic first-instance fine. It also lands at the worst possible moment, since the businesses relying on those programmes are exactly the ones least likely to have audited their site.
Your Contact Form Is Where Most Spanish Sites Fail
Under the RGPD as adapted by the LOPDGDD, every form collecting personal data — contact, quote request, newsletter, registration — needs an unticked consent checkbox that the visitor actively selects, plus a short informative clause visible near the submit button naming the data controller, the purpose, the visitor’s rights, and a link to the full privacy policy. Sending marketing on top of that requires its own separate checkbox. It sounds fussy written out. In build terms it is twenty minutes of form work that gets skipped roughly every time a site is put together in a hurry, and it stays broken until someone rebuilds the site or a complaint arrives.

Yes. The LSSI-CE does not distinguish by company size. Any natural or legal person providing services over the internet as an economic activity falls under article 10, including a sole trader with a simple presentation site.
It has to be easily reachable from any page of the site, which in practice means a footer link. Burying it inside terms and conditions or behind a form does not satisfy the accessibility-of-information requirement.
No. The aviso legal identifies who runs the site under the LSSI. The privacy policy covers data processing under the RGPD and LOPDGDD. The cookie policy is a third document again. Merging them into one page is a common shortcut that tends to leave gaps in all three.
