Four Laws Decide What Goes in an Austrian Impressum
Austria stacks its disclosure obligations in a way that catches people out. §5 ECG covers every commercial website and company social media profile. §25 MedienG adds a separate Offenlegung whose scope depends on whether the site goes beyond self-presentation into opinion-forming content — which a regularly updated company blog often does. §14 UGB applies to businesses in the Firmenbuch, with websites treated as electronic business letters. §63 GewO catches traders without a Firmenbuch entry. The Impressum has to be reachable from every subpage in no more than two clicks. Penalties are split accordingly: up to €3,000 under §26 ECG, and up to €20,000 under §27 MedienG for an Offenlegung failure.
A German Template Will Get Half of This Wrong
This is the single most common defect on Austrian sites, and it is entirely self-inflicted. A page citing "§5 TMG" is quoting German law on an Austrian website — the correct reference is §5 ECG. More importantly, Germany has no MedienG Offenlegungspflicht, so a German template omits that obligation entirely rather than merely mislabelling it. The other frequent error, inventing a Firmenbuch number for a foreign entity, is the expensive one, because it moves the problem out of administrative-penalty territory and into unfair-competition litigation. Competitors can and do bring Unterlassungsklagen under §14 UWG over defective disclosures.
The ODR Link Went From Requirement to Mistake
Until mid-2025, businesses concluding contracts with consumers online had to link to the EU’s Online Dispute Resolution platform. That platform no longer exists, and the WKO advises removing the notice and the link. An Impressum still pointing at it sends visitors nowhere. Do not confuse this with §19 AStG, which is unchanged: if you are committed or legally required to use a consumer arbitration body, you still have to name it and give its website address clearly and accessibly. Only the extra ODR link fell away.
BaFG Applies to Transactional Sites, Not All of Them
The Barrierefreiheitsgesetz has applied since 28 June 2025, implementing the European Accessibility Act. It reaches websites offering a digital service to consumers — a webshop, online ticketing, booking, online payment, online donations — and those sites need a Barrierefreiheitserklärung under §14(2). A purely informational company site with contact details is generally outside it, which is a real distinction and worth stating rather than letting fear do the work. The BaFG itself names no specific WCAG version, referring instead to harmonised standards, in practice EN 301 549. The Sozialministeriumservice supervises and can impose administrative penalties up to €80,000, consumers can report violations directly, and — going by what happened next door after Germany’s equivalent law — competitor warning letters are a realistic second front. Keeping contrast, alt text and keyboard operation right through routine maintenance is cheaper than answering one.
