The PDPA Reform Landed in 2025 and Changed the Footer
Malaysia’s Personal Data Protection (Amendment) Act 2024 rolled out in stages between January and June 2025, the largest overhaul of Act 709 since it began operating. The obligation that touches a website directly: organisations required to appoint a Data Protection Officer must publish that officer’s business contact information on their official website, in privacy notices and in security policies, including a dedicated official business email account. This is a page element, not an internal document — and it is new enough that a large share of Malaysian sites still have no trace of it.
Who Actually Needs a DPO
The duty falls on both data controllers and data processors, but only above thresholds set out in the Commissioner’s guidelines of 25 February 2025, which turn on processing personal data at scale, handling sensitive personal data at scale, or carrying out regular and systematic monitoring of individuals. A small business with a contact form and a customer list is usually below that line. The requirements on the person are specific: resident in Malaysia for at least 180 days a year or otherwise easily contactable here, and proficient in both Bahasa Melayu and English. Registration goes through the Commissioner within 21 days of appointment.
Breach Notification Now Runs on a Clock
For over a decade the PDPA required no breach reporting at all. Since June 2025 a data controller with reason to believe a personal data breach has occurred must notify the Commissioner as soon as practicable and within 72 hours of becoming aware, and where the breach is likely to cause significant harm, tell the affected individuals as well. Failure to notify carries a fine up to RM250,000 and up to two years’ imprisonment. Meeting a 72-hour window requires knowing what your site collects and where it goes before anything happens — logging, access control and a current stack, which is the case for building on something maintainable rather than a plugin pile.
The Penalty Ceiling Roughly Tripled
The maximum fine for breaching the PDPA’s data protection principles moved from RM300,000 to RM1,000,000, with maximum imprisonment rising from two years to three. The Act binds any business, local or foreign, processing the personal data of people in Malaysia in a commercial transaction. Worth reading alongside Singapore’s regime if you operate across both, because the two look similar from a distance and differ in the details that matter — Singapore requires a DPO of every organisation regardless of size, Malaysia only above threshold.
