The ACCC Has Already Swept Sites Like Yours
This is not a theoretical regulator. In an October 2022 sweep the ACCC examined 137 businesses over ten days and found 37% engaged in conduct of concern around fake or misleading online reviews; a parallel review of 118 influencers found 81% posting in ways that raised Australian Consumer Law concerns. In 2025 the ACCC reviewed around 2,000 Australian retail websites specifically for their returns policies and terms and conditions. HealthEngine, a healthcare booking service, was ordered by the Federal Court to pay $2.9 million in penalties. Part of the conduct: it declined to publish a large volume of negative reviews submitted between March 2015 and March 2018, and edited others to strip out the negative parts. Curating your best feedback into a highlight reel is ordinary marketing. Systematically suppressing genuine criticism so the overall impression looks better than reality is a different thing, and the line generally sits at whether a consumer walks away with an accurate picture. Incentivised reviews are allowed, but the incentive has to be offered regardless of whether the review turns out positive, and it has to be disclosed.
You Cannot Write the Consumer Guarantees Out of Your Terms
The ACL guarantees — acceptable quality, fit for purpose, matching the description — are automatic and cannot be excluded by contract. A returns page reading "all sales final" doesn’t limit anything; it is itself a misrepresentation of consumer rights, and misrepresenting the guarantees is exactly what that 2,000-site sweep was looking for. Claims About the Future Need Grounds at the Moment You Make Them
Under the ACL, a business making a representation about a future matter must have reasonable grounds for it when the claim is made, and the burden of showing those grounds sits with the business, not the complainant.
