The Complaints Book Link Is a Legal Element of Your Website

Portugal has an obligation most other countries do not, and it lands directly on the page rather than in a filing cabinet. Under Decreto-Lei n.º 156/2005 as amended, businesses supplying goods or services to the public must hold both a physical and an electronic complaints book — and if the business has a website, it must display access to the livroreclamacoes.pt platform there, in a visible and prominent position. Not tucked into terms and conditions. The registration is one per company, by NIPC, regardless of how many establishments you run. If a business has no website at all, it needs a dedicated email address to receive complaints instead.

Any Site That Shows a Product and a Way to Buy It Is Covered

The scope catches more businesses than the phrase "complaints book" suggests. The reading applied in practice is that a website presenting a good or service and giving contacts through which the purchase can be made brings the operator inside the electronic complaints book obligation. So a brochure site for a clinic, a workshop or a studio with a phone number on it is not automatically outside this because it takes no payments online. ASAE is the general enforcement authority, with sector regulators handling their own areas — the AMT for mobility and transport, for instance.

Enforcement Starts With a Ninety-Day Window

Decreto-Lei n.º 9/2020 added an article that changes the risk profile considerably. A business without the electronic complaints book can regularise within 90 days of being notified by the competent authority, and proceedings are opened only if it fails to do so in that window. Fines vary by seriousness and company size, and repeat conduct makes them worse. The practical reading: this is not a trap that springs without warning, but it is also not something to leave until a notification arrives, because the notification usually means a customer already tried to complain and could not find the link.
