There is no small-business exemption under Title III, and plaintiff firms find violations using automated scanners, which means a five-person online store gets evaluated by exactly the same tool as a national chain. Small businesses simply settle faster.
Accessibility Widgets Are the Expensive Wrong Answer
The single most common thing a US business owner does after a demand letter is install an overlay widget, and the litigation data is blunt about how well that works. In the first quarter of 2026, about a quarter of all ADA website filings were against sites that already had an accessibility widget running. UsableNet’s review of monthly filing volumes found no meaningful drop-off for widget users at all. A widget layers a menu on top of the page; it does not change the HTML underneath, and the HTML underneath is what a screen reader parses and what a complaint quotes. Real remediation means semantic markup, labelled form fields, keyboard-operable controls and contrast that passes — decisions made during the build, not patched over afterwards.

In Q1 2026 Illinois led every state with 256 website accessibility filings, about a quarter of the national total, with California second at 194. Questions, Answered Directly
Title III has no small-business exemption. Courts have applied it to websites of businesses treated as public accommodations, which covers most public-facing businesses, and the filing data shows small e-commerce operators being sued in large numbers rather than only household-name brands.
Title III does not name a technical standard, so strictly speaking there is no statutory number to hit. In practice courts, settlements and demand letters all use WCAG 2.1 Level AA as the benchmark, which makes it the working standard. The separate 2024 Department of Justice rule that does name WCAG 2.1 AA applies to state and local government bodies under Title II, not to private businesses — that distinction gets misreported often.
The filings suggest not. Roughly a quarter of Q1 2026 cases were against sites already running one, and plaintiffs increasingly cite code-level barriers that the widget never touched.
