The CMA published updated guidance on unfair contract terms in July 2026, and it says something operators should read carefully: where a business recommends or tries to enforce a term that is unfair under the Consumer Rights Act, that is "inherently likely" to amount to an unfair commercial practice under the newer regime as well. So a questionable clause is no longer merely unenforceable against the member. It is a route into an investigation with turnover-based penalties attached.

The established position is well documented. A contract that does not let someone cancel because of serious injury or illness is regarded as unfair, as is one that refuses cancellation after a genuine change in circumstances such as job loss. Minimum terms running beyond twelve months have been challenged successfully, and automatic renewal without clear permission sits in the same category. A membership page that states these exits plainly loses very few sales and removes the argument entirely.
What Is Actually Coming, and When
The subscription-specific regime — auto-renewal reminder notices, renewal cooling-off rights, a cancellation route as easy as the signup route — still needs secondary legislation and is not expected before 2027. Worth knowing, and worth not using as a reason to defer.
